There have been a number of cuts to legal aid over the last few years which has severely reduced the public’s access to justice. These cuts have meant that vast quantities of people have not been able to access the legal assistance they needed, at the most important and sometimes challenging of times.

At Allington Hughes, we have several departments which can still provide legal advice with the assistance of legal aid, subject to means testing.

Family Law Legal Aid


Since April 2013, there have been severe restrictions on Legal Aid. However, it is available in certain situations, such as where social services are involved with your family or where you and/or your children have been victims of domestic abuse, subject to you meeting the correct income and capital requirements.

Legal aid is generally only available for those who are on a low income or benefits and can satisfy the financial limits set by the Legal Aid Agency. If you or your partner has savings, properties, income from employment or other sources of income then we can assess whether you are financially eligible for legal aid. Legal aid is also still available for mediation. We can advise you on this free and without obligation, prior to any appointment.

Legal aid for legal advice and representation is available for the following types of family law cases:

  • Applications for non-molestation and occupation orders;
  • Applications for restraining orders under the Protection From Harassment Act 1997;
  • Applications for forced marriage protection orders;
  • Applications for orders in relation to children who have been unlawfully removed to a place within the UK;
  • Applications for orders in relation to children who have been abducted or unlawfully removed to a place outside the UK;
  • Proceedings brought by the local authority for care or supervision orders;
  • Mediation.

We can also offer a number of flexible payment options, such as fixed fees in certain cases, and we will always give you a clear and transparent estimates so that you are always aware of the cost implications of your case at the outset.

Criminal Law Legal Aid


There has been much uncertainty surrounding the provision of Legal Aid in criminal proceedings, with many firms closing as a result. However we are firmly committed to providing advice and representation of the highest quality to clients who require the assistance of Legal Aid.

What many people do not realise is that everyone, regardless of their finances, is entitled to a solicitor of their choice to represent them free of charge when interviewed at a Police Station. As a result we have representatives on call 24 hours per day, 7 days per week in order to assist anyone who requires our services. If you are the subject of an investigation by another agency, other than the Police, you may be entitled to Legal Aid but this would be based on your income level.

If you are required to attend court in respect of any allegations then we can apply for Legal Aid on your behalf, this is assessed on your financial circumstances but also the seriousness of the case. Cases before the Magistrates Court are assessed purely on your level of income. If your case was to be dealt with at the Crown Court then Legal Aid is available in nearly all Crown Court cases, even when you are not financially eligible at the Magistrates Court, but you may be required to make monthly contributions towards the cost of the Legal Aid. If you have in excess of £30,000 in assets/capital you could be required to pay contributions from this. If you were found not guilty at the Crown Court any contributions you had made would be refunded to you with interest.

Housing Legal Aid


We are the only firm of solicitors in Wrexham that has been granted a contract to provide legal aid on housing matters to include mortgage repossession cases. We have a contract in the category of housing and subject to means testing, can advise and assist clients with the benefit of legal aid. In the alternative, we are always willing and able to offer cost effective advice and competitive fixed fees.

Legal aid is still available for the following Housing cases:

  • Possession proceedings and eviction – including counterclaims for disrepair
  • Unlawful eviction
  • Homelessness including asylum support for accommodation
  • Anti social behaviour cases
  • Harassment injunctions
  • Serious disrepair
