The firm was founded in 1826 when Thomas Hughes established himself as a solicitor in Wrexham. 1855 The first office was on Hope Street, Wrexham then Thomas Hughes opened a new practice at 31-32 Regent Street. 1863 Thomas’ eldest son John Allington Hughes joined the practice after training in London, then becoming the owner of the firm after Thomas’ death in 1863. 1899 In 1899, after serving his articles with the firm, Joseph Henry Bate became partner and the practice changed its name to J Allington Hughes and Bate. In some circumstances, we may charge a Value element in addition to the Time-Costs element. We set out our Time-Costs pricing structure, which shows a range of costs and scenarios. These prices cover estates that are uncontested and where all the assets are situated in the UK. Whether we charge a Value element in addition to our Time-Costs element will be determined by a number of different factors. These may include the value of the estate, the complexity of the matter, whether the estate qualifies for certain reliefs such as Agricultural Property Relief, known as APR, or Business Property Relief, known as BPR, and whether any land involved is unregistered. We will also take into account the skill, labour, specialised knowledge and responsibility involved in dealing with the estate. In accordance with Law Society guidance, the Value element will be charged at up to 1.5% of the gross estate, excluding the value of the deceased’s residence, in estates where one or more of our directors act as executors, whether solely or jointly with anybody else. Where we are not acting as executors, the Value element will be charged at up to 1% of the gross estate, excluding the value of the deceased’s residence. This is an order solely sought by the Police, a complainant of stalking cannot apply to the courts directly as they would with Non-Molestation Orders (NMOs) or Restraining Orders. The Police may apply for a SPO where: A victim has reported stalking behaviour, or it has come to the attention of police during a separate investigation, or by other means (such as a third-party referral through the MARAC/MAPPA processes or from another member of the public); At any point during the course of an investigation, up to and including the point of conviction (or acquittal), or where an investigation has not yet commenced; and There is a belief the victim is at risk of harm from the respondent and an order is necessary to protect them from such risk. A SPO is a civil order which carries a criminal conviction for any breach, much like a Domestic Violence Protection Order (DVPO). The Police can apply to the court for a Full or Interim SPO. Applications for either must be made to the Court and there is no Domestic Violence Protection Notice (DVPN) equivalent. Please see our article on DVPNs and DVPOs for further information, available here. SPOs are designed as an intervention for stalking behaviour prior to criminal court proceedings and/or conviction. However an SPO can be applied for at any point during criminal investigations and proceedings. They can be imposed on adults aged 18 and over as well as children aged 10 to 18 years old. Any SPO on a youth must be dealt with by the Youth Court. Duration An SPO can last for a minimum of 2 years up to an indefinite period (until further order) and can contain both prohibitions and/or requirements. Application Process & Test Applied by the Courts Whilst the application process for both an interim and full SPO is the same, the test applied by the Court is different. Interim SPO When considering whether to make an interim order, the court can make one ‘if it considers it appropriate to do so’ as per section 5(3) of the Stalking Protection Act 2019. An interim SPO could potentially be made more quickly on an immediate assessment of risk, before a full examination of the evidence to determine the application for a full SPO. This is a lower threshold than that required to make a full SPO. It is likely that the courts will not apply the criminal standard of proof (beyond reasonable doubt) to the fact-finding elements of an interim SPO application, but rather apply a lower test, namely treating it as an exercise of judgement or evaluation. Full SPO When considering whether to make a full SPO the court can make one if it is ‘satisfied that an order is ‘necessary to protect another person’ from stalking as per section 2(1) of the Stalking Protection Act 2019. It is likely that the courts will apply the criminal standard of proof (beyond reasonable doubt) to the fact-finding elements of a full SPO application. The questions for the courts to consider in respect of fact-finding will be: Whether the defendant has carried out acts associated with stalking; and Whether the defendant poses a risk associated with stalking to another person. It is likely that the courts will not apply the criminal standard to the non-fact-finding elements of both the interim and full SPO applications, namely whether they consider an SPO is either ‘appropriate’ (Interim) or ‘necessary’ (Full). Hearing An application will be made to the court by the Police and a Summons will then be sent to the respondent. If the application is contested, then then evidence will need to be heard. As with DVPOs, the rules in respect of civil evidence apply and so hearsay evidence is admissible. Notification Anyone subject to a SPO must notify the Police of their name(s) and their home address within a period of 3 days from the date the SPO is served. Failure to do so is a criminal offence, the same as with notification requirements for sexual offences, and carries a maximum of 5 years’ imprisonment. Breach of a SPO Any breach of a SPO is punishable by either the Magistrates’ Court or the Crown Court and carries a maximum sentence of 5 years’ imprisonment. A breach of an interim or full SPO carries the same sentence. Funding Legal Aid may be available to the person subjected to a SPO including proceedings for the making, varying, discharging, renewing and appealing of an SPO, as well as in relation to proceedings for breach of a SPO or failure to comply with notification requirements. Criminal Court A DAPO can be applied for by the police or within ongoing criminal proceedings. If it applied for by the police a Domestic Abuse Protection Notice would be served and an application for a DAPO must be made within 48 hours (excluding weekends and public holidays). A complainant can report domestic abuse and ask the police to apply on their behalf or, if a complainant is not supportive, the Police can apply and support the application with call out information and previous convictions. Even without a complainant, if a pattern of police involvement can be demonstrated the application would likely be successful. A defendant can contest the application and the matter would then proceed to a trial to determine if the contents of the application are accurate and/or if the DAPO is necessary and proportionate. If DAPO is made without the complainant’s support, they can also make an application to the Court for the Order to be removed. Family Court A DAPO can be applied for by the protected person or by a third party such as a family member, friend, social worker or domestic abuse support worker. They can be applied for without notice which means the application would be submitted, the Court would grant the Order and the DAPO would be served on the respondent with a return hearing date. Process The process in both Courts is similar. The Order can be agreed, amended or contested. If it is agreed; You will be required to comply with all of the prohibitions for as long as the Order states You will be subject mandatory notification requirements. This means that you must tell the police your name and address and any changes to these during the operational period. The initial notification must be within 3 days of the Order being made and any changes must be within 3 days. Some DAPO’s can also include electronic monitoring requirements (tag) or positive requirements such as behaviour change programmes. If it is to be amended; You would be required to attend the hearing date you are given and notify the applicant (this could be the police, protected person or other third party) and court that you do intend to agree but wish to discuss the terms. You must set out which conditions you take issue with, the reason for this and potential alternatives if removal isn’t agreeable. Most of the time conditions can be agreed outside of the court room. If the other party does not agree then the matter would be set down for a contested hearing where a Judge or Magistrates’ would hear arguments from both sides before making the final order. The original Order would remain in place until a final decision is made. If it is to be contested; In the criminal court: A court hearing will take place within 48 hours and you would be required to attend to notify the applicant and court that you do not agree and wish to contest. A trial date would be set and the Police would be required to serve all evidence that they wish to rely on by a date set by the Court. The trial would take place and would involved the police presenting their case to the Court and you giving evidence. The burden of proof is less than the usual criminal standard of beyond reasonable doubt in these applications and is instead on the balance of probabilities. It is more likely than not that the behaviour has occurred. The Court will first consider the burden of proof before then deciding if the DAPO is necessary and proportionate depending on their previous verdict and the evidence they have heard. In the family court: A court hearing will likely take place without notice where the DAPO would be granted on the basis of the contents of the application alone. The DAPO and application would be served along with a return hearing date. You would be required to comply with the prohibitions and notification requirements in the meantime. You would attend on the return hearing date to notify the applicant and court that you do not agree and wish to contest. The Court would set a timetable roughly as follows; Applicant to serve statement, exhibits and any witness statements Respondent to serve statement, exhibits and any witness statements Contested hearing/trial The Court would consider the evidence of both parties and first decide on the balance of probabilities if the behaviour has occurred. It is more likely than not that it has. The Court will then decide if the DAPO is necessary and proportionate depending on their previous verdict and the evidence they have heard. Due to the nature of the cases that find themselves before the Court for DAPO proceedings, the parties will not be able to cross examine each other during the trial. You can instruct a solicitor The court may instruct a solicitor for the purpose of cross-examination You may be required to prepare a list of questions, send these to the Court to review and a pre-trial hearing would be required to consider them. The Legal Advisor would then ask your questions on your behalf during the trial. Legal Aid and Private Funding In criminal proceedings, a Legal Aid application could be made should the matter proceed to trial however it is still subject to the usual means and merits tests. It would vary application to application if the Legal Aid Agency felt it was in the interests of justice to provide funding to contest the application given it’s civil nature. In family proceedings, the protected person would likely be granted Legal Aid however if the applicant is a third party this may cause some difficulty. A respondent however would not pass the merit’s test as they are not the person requiring protection. If you were not eligible for Legal Aid you could privately instruct a solicitor however there are not set rates as each case varies in workload. Alternatively you could represent yourself and in some cases the Court may instruct a solicitor to cross-examine on your behalf. Breach of a DAPO It is a criminal offence to breach a DAPO, specifically: Breach a prohibition of a DAPO without reasonable excuse, Fail to comply with the notification requirements without reasonable excuse or give false information to the police, Fail to comply with the electronic monitoring or positive requirements Fail to keep in contact with the person responsible for monitoring compliance with the conditions This is an either-way offence that can be dealt with in the Magistrates Court or the Crown Court. If convicted of the offence the penalty ranges from a fine to a term of imprisonment. If the breach is particularly serious and the case is sent to the Crown Court, a sentence of up to 5 years imprisonment can be imposed. DVPNs and DVPOs were designed to combat domestic abuse allegations where there is insufficient evidence to provide a realistic prospect of conviction, usually where a formal complaint statement has not be made. They allow conditions, similar to bail conditions or a restraining order, to be imposed for a maximum of 28 days in the hope that a reluctant complainant proceeds to make a formal statement of complaint and supports a prosecution, after being afforded some protection by the Police and Courts. Whilst DVPNs and DVPOs are dealt with before the criminal courts they are actually civil proceedings. However, breach of a DVPO is a criminal offence and can result in a prison sentence of up to 2 months. Domestic Violence Protection Notice (DVPN) A DVPN may be issued to you, providing you are over 18, if the Police have reasonable grounds for believing that: You have been violent towards, or have threatened violence towards, an associated person, and The issue of the DVPN is necessary to protect that person from violence or a threat of violence by you. An associated person includes those persons who: Are or have been married to each other or civil partners Are Cohabitants or former cohabitants (living together as husband and wife or civil partners) Live or have lived together in the same household, otherwise than merely by reason of one of them being the other’s employee, tenant, lodger or boarder Are relatives Have agreed to marry one another or enter into a civil partnership (whether or not that agreement has been terminated) Have or have had an intimate personal relationship with each other which was of significant duration Before issuing a DVPN, the Police must consider, specifically; – The welfare of any person under the age of 18 years whose interests the officer considers relevant to the issuing of the DVPN (whether or not that person is an associated person), The opinion of the person, for whose protection the DVPN would be issued, as to the issuing of the DVPN . Any representations made by you as to the issuing of the DVPN. Whilst the Police must take into account the opinions and views of the associated person, as well as any representations you make, these are not overriding factors and, ultimately, it is a decision for the Police. What this means in practice is that should your partner make an allegation against you but then be unwilling to provide a formal statement to the Police or support a prosecution, you could be served with a DVPN which would usually prohibit you from contacting your partner, attending their address or attempting to evict or exclude them from the address. It is irrelevant whether the address belongs to you or is in your name. If there has been a history of Police involvement between you and your partner, or other associated person, then there is a higher likelihood that a DVPN will be issued. If you are served with a DVPN you will also be told, within the Notice, of the date, time and location of the proposed hearing for the Police’s application for a DVPO. This must take place within 48 hours of the DVPN being issued. Breach of a DVPN If you breach a DVPN the Police have the power to arrest you and bring you before the Magistrates’ Court within 24 hours, at which point the application for a DVPO will be heard. If, for whatever reason, the application for a DVPO is not dealt with at the first hearing then the Court have the power to adjourn the case and either release you on bail or remand you in custody. If you have come before the Court because you have breached the DVPN then the chances of you being remanded, should the case be adjourned, are higher. During any adjournment the DVPN will still be in force. Domestic Violence Protection Orders (DVPO) Application for a DVPO For the Police to apply for a DVPO they will need to make a formal application before the Magistrates’ Court, within 48 hours of the DVPN. In order to make a DVPO the Court must be satisfied that the following conditions are met: On the balance of probabilities that you have been violent towards, or has threatened violence towards, an associated person, and, The Court thinks that making the DVPO is necessary to protect that person from violence or a threat of violence by you. As this is a civil application the standard of proof is “on the balance of probabilities” rather than the criminal standard of proof of “beyond reasonable doubt”. What this means is the Court must believe it is “more likely than not” that violence has been used or threatened, rather than them being “sure”. In reaching their conclusion the Court can consider hearsay evidence, such as body worn camera footage. Similar to the issuing of a DVPN whilst the Court must take into account the opinions and views of the associated person these are not overriding factors and, ultimately, it is a decision for the Court. The Courts can, and do, make DVPOs in circumstances where the person for whose protection it is made does not consent to its making. You are entitled to attend this hearing and make representations to the Court as to why you feel the Order should not be granted. It is possible to apply for Legal Aid to enable you to be represented at Court. Should the Court grant the Police’s application then the DVPO can run from no less than 14 day to no more than 28 days. There terms of the Order will likely be similar to the terms of the DVPN, however a copy of the Order will be sent to you and it important for you to carefully read the conditions set out by the Court to avoid any inadvertent breaches. Once a DVPO is made there is no provision to appeal, vary or revoke it. The Order must run until the period granted. Equally there is not power to extend of vary the Order by the Police after it is made. Breach of a DVPO If you are suspected of breaching a DVPO then you can be arrested and brought before the Court in custody within 24 hours (excluding Sundays and Bank Holidays). Legal Aid is available for breach matters to enable you to be represented at the Court hearing. If you accept breaching the Order the Court will proceed to sentence you. If however you dispute the allegation then the Court will hear submissions from the Police advocate and you, or your solicitor. Again hearsay is acceptable evidence and the Court will consider their verdict based on the submissions they have heard and determining on the balance of probabilities as to whether you have breached the Order. If you plead guilty or are found to be in breach of a DVPO the Court have three sentencing options at their disposal: Take no action against you Fine you a maximum of £50 for every day which you were in breach Send you to prison for a maximum of 2 months It is of note that the Court have no power to impose a suspended sentence for this offence and the Early Guilty Plea scheme does not apply, however representations can be made to the Court to request that they consider giving you credit if you have accepted breaching the Order at the earliest opportunity. An Adoption Order is an Order of the Court which effectively terminates the Parental Responsibility of the birth parents, and appoints the adopters as the child’s legal parents. The adopters will thereafter be viewed in law as the child’s parents, and can exercise Parental Responsibility in the same way that a birth parent would. Can I oppose a local authority’s application for adoption? A local authority ‘s application for an adoption order is usually made only after conclusion of Care and Placement proceedings. Where a placement order is in force, a birth parent must seek leave (permission) to oppose the making of an adoption order. There is a two stage test the Court will consider in deciding whether to grant permission. Firstly, has there been a significant change in the parent’s circumstances since the Placement order was granted, and secondly, having considered all the circumstances and with the child’s welfare throughout his or her life being paramount, should leave be given? The second part of the test will focus on the child’s welfare, the parent’s prospects of success and the child’s welfare throughout his or her life. What is the difference between a placement order and an adoption order? A Placement Order is the order authorizing a local authority to place a child for adoption with approved proposed adopters. The Adoption order is the step which actually terminates the legal ties between the child and the birth parents and effectively makes the adopters the legal parents of the child. Can I adopt my partner’s child? This would be called a Step Parent Adoption. To apply, you and your partner must have lived together with the child for a minimum of 6 months, and you must give the local authority in which you live a minimum of 3 months notice of your intention to apply, so that they may carry out an assessment to assist the Court. An important part of that assessment will be to consider the involvement or otherwise of the other parent, as an adoption order for a step parent would strip the non resident parent of all parental responsibility. If the child is cared for between two homes or parents, this is therefore not likely to succeed and their consent to an adoption by a step parent would only be dispensed with if the Court determined that the child’s welfare required this. Family and Pregnancy matters e.g. Maternity, Paternity, Adoption and Shared Parental Leave and Pay rights Under the new Employment Rights Act 2025, employees will gain day-one rights to paternity leave and unpaid parental leave, along with stronger protections against dismissal during pregnancy and for at least six months after returning from maternity leave. Disciplinary and dismissal Dismissal is when your employer ends your employment, and they do not always have to give you notice. If you’re dismissed, your employer must show they’ve followed the correct legal procedures. Interviews under Caution by other agencies At Allington Hughes, we have vast experience of dealing with a broad range of regulatory offences, including trading standard offences, local authority offences and taxi licensing. We can offer advice and representation at all stages of proceedings but it is always advisable to seek expert advice at the earliest opportunity. As with all criminal and regulatory cases the first action any department or agency will take after an allegation has been made, or a suspected offence has been committed, is to investigate the matter. This will usually result in speaking to those suspected of being involved in the alleged offence at interview conducted under Caution, in compliance with the Police and Criminal Evidence Act 1984 (PACE). An interview conducted in this way enables the contents of the interview to form part of any court proceedings. It is obviously important that should you or one of your employees find themselves in a position where they are to be interviewed under Caution that you obtain the correct advice as to how to proceed in the interview. Interviews conducted in accordance with PACE provide the interviewee with the right to obtain legal advice. You or your employees should always take up this right, even when you do not think you have done anything wrong, as it will enable you to be fully advised as to what the allegations against you are and your options before the interview begins. Without a legal representative you will not be made aware of the details of the allegations before the interview begins. Sometimes things can be said during interview which unintentionally strengthen the case against them. Interviews of this nature may be conducted by the Police but with more specialised investigations, for example those conducted by the Information Commissioner’s Office, civilian investigators from that organisation will usually have conduct over the entire investigation, including the interview under Caution. This is important to note for two reasons; The interviewers will usually be specialised in their specific field of investigation and will therefore know a great deal about the area they are investigating and the legislation that accompanies it. She also deals with cases involving domestic abuse, abduction, forced marriage, abuse and adoption application. She can represent parents and extended family members, or children themselves via their appointed Guardian. Grisial also undertakes publicly funded work and can advise on eligibility for Legal Aid in such matters.
