Fixed Recoverable Costs – Changes that came into force on 1 October 2023

What are fixed costs?

Fixed recoverable costs (FRCs) set the amount of legal costs that the winning party can claim back from the losing party in civil litigation. They already apply in most low-value personal injury cases.

The winning party can be either the claimant or the defendant is entitled to recover costs from the losing party at difference stages of the litigation process, from pre-issue to trial. The term ‘costs’ can typically include solicitor’s fees, court fees, expert witness fees and certain other disbursements exclusive of VAT.

The changes introduced are:

  • fixed recoverable costs will now extend to civil cases rather than low-value personal injury cases;
  • a new intermediate track includes simple cases valued between £25,000 and £100,000 in damages;

Please note that these changes will not apply to Part 8 claims (these should be allocated to multi-track) and will not apply to Judicial Review and Solicitors Act 1974 challenges.
