Separation agreements


A separation agreement is for both married and unmarried couples who no longer want to live together. Separation agreements can cover aspects such as children, finances and property, with examples such as:

  • Children – who they will live with, how much time will be spent with each parent, child maintenance payments etc
  • Finances – how the mortgage will be paid, how loans will be covered, whether one member of the couple should pay maintenance to the other etc
  • Property – will the house be sold, how will proceeds of the sale be shared, how to split assets in the house etc

If you are unmarried and co-habiting, a separation agreement is particularly useful as you do not share the same rights as a married couple and are not protected by law in the same way.
